2. How We Collect Your Information

We collect personal information in the following ways:

Directly from you when you place an order, create an account, or contact us
Automatically when you use our website, including through cookies and similar technologies (see Section 3)
From service providers such as Shopify and payment processors who support our operations
From analytics and advertising platforms, where you have consented to the use of such technologies
From nominated individuals, recipients, or honourees where you have provided their details for Gift Plan activation or fulfilment

Where you provide personal information about another person (such as a nominee, recipient, or honouree), you confirm that you are lawfully entitled to share that information with us for the purpose of providing our Services.

3. Cookies, Analytics and Advertising

Our website uses cookies and similar technologies (including pixels, tags and local storage) to operate the site, to understand how it is used, and to measure and deliver advertising.

Categories of cookies we use

Strictly necessary – required for the website to function, including maintaining your basket, processing payments, security, and remembering your cookie preferences. These are placed without consent, as permitted by law, and cannot be switched off.
Analytics and performance – help us understand how visitors find and use our website, so that we can improve it.
Advertising and targeting – set by us or by our advertising partners to measure the performance of our advertising, to show you adverts for Evermore on other websites and platforms, and to help us reach people with similar interests.

Your consent

We place analytics and advertising cookies only where you have given your consent through the cookie banner displayed when you first visit our website.

You may change or withdraw your consent at any time using the cookie preferences option on our website, or by managing and clearing cookies through your browser settings. Withdrawing consent does not affect the lawfulness of any processing carried out before it was withdrawn.

Third-party analytics and advertising providers

Where you have given consent, the following third parties may set cookies or otherwise receive information about your use of our website:

Google (including Google Ads and related measurement services) – to measure website activity, track the performance of our advertising, and deliver advertising
Meta (Facebook and Instagram) – to measure the performance of our advertising and to deliver advertising on Meta platforms
Shopify – our ecommerce platform, for essential store functionality and site analytics
Klaviyo – our email marketing platform, to identify subscribers and measure engagement

In respect of some of this processing, these providers may act as independent controllers or as joint controllers alongside us, and will handle your information in accordance with their own privacy policies. We encourage you to review those policies.

Server-side measurement

In addition to cookies placed in your browser, we use server-side measurement tools (including Meta’s Conversions API and Google’s conversion measurement) where you have consented to advertising cookies.

These tools send limited information about actions taken on our website – such as submitting an enquiry or completing a purchase – directly from our systems to the relevant advertising platform. Where this information includes identifiers such as an email address or telephone number, it is hashed (converted into an irreversible string of characters) before being transmitted, and is used by the platform to attribute the action to an advertising account and to measure advertising performance.

4. How We Use Your Information

We use personal information for the following purposes:

Providing our Services – processing orders, taking payment, arranging deliveries, scheduling gifts for selected dates, administering Gift Plans, and managing refunds or cancellations
Customer support – responding to enquiries and communicating with you
Marketing – sending promotional emails or updates where you have actively opted in (you may withdraw consent at any time)
Advertising and measurement – where you have consented to advertising cookies, measuring the performance of our advertising, showing you adverts for Evermore on third-party platforms such as Google and Meta, and creating audiences of people with similar characteristics
Analytics and improvement – where you have consented to analytics cookies, understanding how our website is used so that we can improve it
Security and fraud prevention – protecting our business, customers, and Services from unlawful or fraudulent activity
Legal compliance – meeting legal, regulatory, and contractual obligations

Lawful Basis for Processing

We process personal information only where we have a lawful basis to do so under UK data protection law. Depending on the circumstances, this includes:

Contract – where processing is necessary to provide our Services or administer a Gift Plan
Legal obligation – where we must retain or disclose information to comply with applicable laws (for example, tax or accounting requirements)
Legitimate interests – where processing is necessary for operating, securing, or improving our business, provided those interests are not overridden by your rights
Consent – where you have actively opted in to marketing communications, where you have accepted analytics or advertising cookies, or where consent is otherwise required

5. How We Share Your Information

We may share personal information with:

Shopify, our ecommerce platform, and other service providers who process data on our behalf (such as payment processors, couriers, florists, and IT providers)
Analytics and advertising platforms, including Google and Meta, where you have consented to analytics or advertising cookies (see Section 3)
Nominated individuals, recipients, or honourees you have designated for Gift Plan activation or fulfilment
Business partners for marketing purposes, where you have given consent
Authorities or regulators where required by law or legal process
Successors or professional advisers in the event of a business sale, restructuring, or similar corporate transaction, subject to appropriate confidentiality and data protection safeguards

We do not sell personal information to third parties. Where information is shared with analytics or advertising platforms as described in Section 3, this occurs only with your consent, which you may withdraw at any time.

6. Relationship with Shopify

Our Services are hosted by Shopify, which collects and processes personal information about your use of our website in order to provide and improve its services.

Shopify may process personal data in countries outside the UK or EEA. For further information, please review Shopify’s Privacy Policy.

7. International Transfers

Some of our service providers – including Shopify, Google, Meta and Klaviyo – may process personal information outside the UK or EEA.

Where this occurs, we ensure appropriate safeguards are in place, such as:

Transfers to countries recognised as providing adequate protection; or
Standard Contractual Clauses, the UK International Data Transfer Addendum, or equivalent legal safeguards.

8. Data Retention

We retain personal information only for as long as necessary for the purposes described in this Privacy Policy. This includes:

Retaining order, Gift Plan, and transaction records for as long as required to administer Gift Plans and comply with legal, tax, and accounting obligations;
retaining delivery details, dates, and recipient information for the duration of the relevant Gift Plan;
retaining communications data for customer support and dispute resolution;
retaining marketing data until you withdraw consent or opt out;
retaining analytics and advertising data for the retention periods operated by the relevant platform, or until you withdraw your consent, whichever is earlier.

When personal information is no longer required, it is securely deleted or anonymised.

9. Your Rights

Under UK data protection law, you have the right to:

Access – request a copy of the personal information we hold about you
Correction – request correction of inaccurate or incomplete data
Erasure – request deletion of your personal information
Restriction – request that we limit how your data is used
Portability – request transfer of your data to you or another provider
Objection – object to certain processing, including direct marketing and profiling for advertising purposes
Withdraw consent – where processing is based on consent

Where processing is based on your consent, including the use of analytics and advertising cookies, you may withdraw that consent at any time using the cookie preferences option on our website, without affecting the lawfulness of processing carried out beforehand.

To exercise your rights, please contact us using the details below. We may need to verify your identity before responding.

You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO) at www.ico.org.uk.

10. Children’s Data

Our Services are not directed at individuals under the age of 18.

However, where a purchaser designates a child under 18 as a recipient of a Gift Plan, we may process limited personal information (such as name, delivery address, and delivery dates) strictly for the purpose of fulfilling deliveries.

In such cases:

The purchaser confirms they have parental responsibility or legal authority to share the child’s information;
children’s data is used only for administering the Gift Plan and not for marketing or unrelated purposes;
children’s data is deleted once the Gift Plan is complete, or earlier if requested, in accordance with our retention policy.

If you believe we have collected children’s personal information outside of these circumstances, please contact us so we can address the issue.

11. Security

We use appropriate technical and organisational measures to protect personal information. However, no system is completely secure, and we cannot guarantee absolute security.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated “Last updated” date.
